DERECHO A LA PROPIEDAD INDIVIDUAL DESLAZAMIENTO FORZADO        



Los pueblos indígenas y sus miembros tienen derecho, tanto bajo el artículo XXIII de la Declaración Americana de los Derechos y Deberes del Hombre[264] como bajo el artículo 21 de la Convención Americana sobre Derechos Humanos[265], a la delimitación y demarcación de su territorio por el Estado[266].  En efecto, el principal mecanismo de garantía del derecho de propiedad territorial indígena que ha sido identificado por los órganos del sistema[267] es la delimitación y demarcación de las tierras pertenecientes a los pueblos indígenas[268].  La Corte Interamericana ha explicado que es necesario materializar los derechos territoriales de los pueblos indígenas a través de la adopción de las medidas legislativas y administrativas necesarias para crear un mecanismo efectivo de delimitación y demarcación, que reconozca tales derechos en la práctica       

Indigenous peoples and their members are entitled, both under Article XXIII of the American Declaration of the Rights and Duties of Man [264] as under Article 21 of the American Convention on Human Rights [265], the delimitation and demarcation of its territory by the State [266]. [268] The Court explained that it is necessary to realize the land rights of indigenous peoples through the adoption of legislative and administrative measures necessary to create an effective mechanism for delimitation and demarcation, which recognize such rights in practice
